Past Results
- In October 2011 Jeff Feldman successfully defended a
hematologist/oncologist against claims that he failed to
properly monitor a patient during the immediate post- operative
period following thoracic spine surgery for a suspected mass
compressing the spinal cord. The claims were discontinued
midtrial following the testimony of the codefendant
neurosurgeons.
- In September 2011 Andrew Regenbaum successfully defended a
local emergency room physician in Orange County Supreme Court.
The case involved a claim that the physician failed to diagnose
and treat a patient's fibula fracture thereby causing the
patient to later fall and fracture her knee and ankle. The jury
agreed that the physician's workup and diagnosis was appropriate
and rendered a verdict in favor of the doctor.
- In August 2011 Andrew Regenbaum successfully defended a
local family practitioner in Putnam County Supreme Court. The
case involved a claim that the physician failed to diagnose
breast cancer in a 45 year old woman who presented to the doctor
for a single, problem oriented (acute) visit. During the trial,
it was proven that the patient was not truthful about many of
the events claimed to have occurred during visit. Ultimately,
the jury agreed that the physician's workup of the patient was
appropriate and rendered a verdict in favor of the doctor.
- In July 2011 Andrew Regenbaum successfully defended a local
orthopedic surgeon in Orange County Supreme Court. The case
involved a claim that the physician improperly performed a two
level spinal fusion surgery and thereafter failed to properly
treated the patient's post- operative symptoms. It was alleged
that the improper treatment caused the patient to suffer
bilateral foot drop. After a 7 day trial the jury agreed that
the surgeon performed the surgery correctly, properly managed
the patient's post-operative complaints and rendered a verdict
in favor of the doctor.
- In February 2011, Andrew S. Regenbaum successfully defended a local geriatric physician in Putnam County Supreme Court. The case involved a claim that the physician failed to diagnose and treat a hip fracture in a 78 year old woman with osteoporosis. The jury agreed that the physician's workup was appropriate and rendered a verdict in favor of the doctor.
- On December 15, 2010 Robert R. Sappe successfully defended a local orthopedic surgeon in Supreme Court, Orange County. The plaintiff alleged that the physician negligently managed a fractured tibia, which then failed to heal and resulted in the need for multiple further surgeries in order to get the fracture to heal. Mr. Sappe successfully demonstrated to the jury that the fracture was correctly set by the doctor, and that the reason for the failure to heal was the patient’s own negligence in weight bearing on the fracture before it was healed and continuing to smoke against doctor’s advice.
- July 2010, Jeff Feldman successfully defended a local gastroenterologist in Orange County Supreme Court. Plaintiff claimed that the physician used excessive traction in performing a colonoscopy, leading to the very rare complication of a subcapsular rupture of the spleen. We were able to prove from the medical record that the procedure was uncomplicated and that the procedure was performed properly.
- July 2010, Andrew Regenbaum successfully defended a local cardiologist in Orange County Supreme Court. Plaintiff claimed that the physician failed to send a heart attack patient for an immediate cardiac catheterization. We successfully argued that the doctor followed the proper protocol to treat the patient after diagnosing the heart attack. The plaintiff discontinued the case against the doctor midway through the trial.
- June 2010, Jeff Feldman successfully defended a general surgeon in Orange County Supreme Court. Plaintiff claimed that the deceased 72 year old lawyer died as a result of negligent treatment of a small bowel obstruction. The jury agreed that the physician’s care was appropriate and that the decedent did not die from a bowel obstruction.
- March 2010, Robert Rich Successfully tried a medical malpractice case in Orange County Supreme Court to a defense verdict for a general surgeon. The case involved a claim that the doctor negligently damaged a patient’s ureter during a complicated colon resection.
- March 2010, Andrew Regenbaum successfully tried a medical malpractice case in Orange County Supreme Court to a defense verdict for a local internist. The case involved a claim that the doctor performed an improper medical clearance for a patient undergoing spinal surgery and as a result the patient suffered complications which led to paralysis and death. The jury agreed that the examination performed by the doctor was complete and appropriate in all respects.
- February 2010, Robert Rich successfully tried a medical malpractice case in Federal Court to a defense verdict for a local thoracic surgeon. The case involved a claimed delay in transferring an accident victim to a level one trauma center.
- January 2010, Jeff Feldman obtained a defense verdict for a local ob/gyn in a failure to timely diagnose breast cancer matter. Plaintiff claimed that our client did not properly test or follow up on a complaint of a breast irregularity. The physician claimed no such complaint was ever made by the then 28 year old patient.
- December 2009, Robert Rich successfully tried a medical malpractice case in Westchester County to a defense verdict for a gastroenterologist. The case alleged a failure to timely prescribe surgery for a gallstone.
- August 2009, Andrew Regenbaum successfully tried a medical malpractice case in Orange County Supreme Court to a defense verdict for a local radiology group. The case involved claims of an improperly performed mammogram.
- May 2009, Robert Sappe successfully tried a medical malpractice case in Dutchess County to a defense verdict for a local orthopedic surgeon. The case involved allegations that a surgery was improperly performed.
- March 2009, Andrew Regenbaum successfully tried a medical malpractice case in Sullivan County to a defense verdict for a local emergency room physician. The case involved an allegation of a failure to diagnose a small bowel obstruction.
- March 2009, Robert Rich successfully tried a podiatric malpractice case in Ulster County to a defense verdict for a local podiatrist. The case involved a claim that a foot surgery was performed improperly.
- August 2008, Jeff Feldman successfully tried a medical malpractice case in Dutchess County to a defense verdict for a local obstetrician. The case involved a claim that the use of excessive traction during the course of the delivery, following a shoulder dystocia, resulted in an Erb’s Palsy injury.
- May 2008, Jeff Feldman successfully defended two local obstetricians, who the plaintiff claimed negligently provided prenatal care resulting in a severely brain damaged baby.
- February 2008, Jeff Feldman successfully defended a local ob/gyn in a failure to diagnose breast cancer. It was alleged that the physician failed to pay sufficient heed to the patient's complaints of an irregularity in her breast. It was proven that the patient was fabricating much of her version of the events claimed.
- January 2008, Jeff Feldman obtained a defendant’s verdict for a local surgeon in a case in which it was alleged that the surgeon improperly followed a post surgical patient regarding her use of Lovenox and Coumadin, resulting in very severe bleeding into the retroperitoneal spaces.
